Terms of Service

1. Parties and Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Safe Plated Pte. Ltd. (UEN 202606065Z), a company incorporated in the Republic of Singapore ("Safe Plated", "we", "us", "our"), governing your access to and use of the Safe Plated web application, APIs, and all related services (collectively, the "Service").

By creating an account, accessing, or using the Service in any manner, you represent and warrant that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms in their entirety, you must not access or use the Service.

2. Nature of the Service

Safe Plated is an AI-powered meal planning tool that generates recipe suggestions incorporating allergen-aware ingredient substitutions. The Service uses artificial intelligence models to create recipes, meal plans, shopping lists, nutritional estimates, and related content.

The Service is not, and shall not be construed as, a medical device, medical software, health advisory service, or substitute for professional medical advice, diagnosis, or treatment.

3. Eligibility

You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction, to create an account and use the Service. By using the Service, you represent and warrant that you meet this eligibility requirement. If you are using the Service on behalf of a household or minor children, you accept full responsibility for all use of the Service and any consequences arising therefrom.

4. AI-Generated Content — Critical Limitations

You expressly acknowledge and agree that:

  • All recipes, ingredient substitutions, nutritional information, safety scores, and restaurant assessments are generated by artificial intelligence and may contain errors, omissions, inaccuracies, or fabricated information ("hallucinations").
  • AI models do not have perfect or complete knowledge of every food product, ingredient formulation, manufacturing process, or allergen risk.
  • A recipe or ingredient identified as "safe" by the Service may nonetheless contain allergens that could cause severe allergic reactions, including anaphylaxis and death.
  • Nutritional values, calorie counts, cost estimates, and safety scores are algorithmic approximations, not laboratory-verified or clinically validated figures.
  • The Service cannot detect or account for cross-contamination risks in manufacturing, retail, or home environments.

5. User Responsibilities and Assumption of Risk

You assume full responsibility and all risk associated with the use of the Service, including but not limited to:

  • Independently verifying all ingredients by reading the complete physical ingredient list and allergen warnings on every product you use when preparing any recipe, regardless of what the Service indicates.
  • Assessing and mitigating cross-contamination risks in your kitchen, during food preparation, when purchasing manufactured products, and when dining at restaurants.
  • Monitoring for manufacturer formulation changes. Food manufacturers may change product formulations at any time without notice. You must check current labels for every preparation, including products previously used.
  • Seeking emergency medical care immediately if you or anyone in your household experiences symptoms of an allergic reaction, and maintaining prescribed emergency medication (e.g., epinephrine auto-injectors) as directed by your physician.
  • Consulting qualified medical professionals — including board-certified allergists, immunologists, and registered dietitians — for allergy testing, management, and personalised nutritional guidance.

6. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at support@safeplated.com of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

7. Subscription and Payment

Certain features of the Service require a paid subscription. Subscription fees are charged in advance on a recurring basis (monthly or annually, as selected). All fees are non-refundable except as required by applicable law. We reserve the right to modify subscription pricing upon thirty (30) days' notice. Payment processing is handled by Stripe, Inc., and is subject to Stripe's terms of service.

8. Intellectual Property

All content, software, algorithms, designs, trademarks, and other intellectual property comprising the Service are owned by or licensed to Safe Plated Pte. Ltd. and are protected under applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

AI-generated recipes and content produced by the Service for your account may be used by you for personal purposes. You may not reproduce, distribute, or commercially exploit such content without our prior written consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAFE PLATED PTE. LTD. EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, SAFETY, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (B) ANY AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR FREE FROM ALLERGENS; (C) THE SERVICE WILL MEET YOUR REQUIREMENTS; OR (D) ANY RECIPE, INGREDIENT SUBSTITUTION, OR SAFETY ASSESSMENT IS SAFE FOR ANY INDIVIDUAL.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAFE PLATED PTE. LTD., ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, ALLERGIC REACTIONS, ANAPHYLAXIS, HOSPITALISATION, DEATH, LOSS OF PROFITS, LOSS OF DATA, OR ANY OTHER DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO SAFE PLATED PTE. LTD. IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED SINGAPORE DOLLARS (SGD 100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Safe Plated Pte. Ltd., its directors, officers, employees, agents, and affiliates from and against any and all claims, actions, demands, liabilities, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your failure to verify ingredients, allergens, or any AI-generated content; (c) any allergic reaction, injury, or harm resulting from food prepared using information obtained from the Service; (d) your violation of these Terms; or (e) your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 4, 5, 9, 10, 11, 13, 14, and 15 shall survive any termination or expiration of these Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre ("SIAC") in accordance with the Arbitration Rules of the SIAC for the time being in force. The seat of arbitration shall be Singapore. The language of the arbitration shall be English.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and Safe Plated Pte. Ltd. with respect to the Service and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

16. Amendments

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least fourteen (14) days before taking effect. Your continued use of the Service after the effective date of any amendment constitutes your acceptance of the revised Terms.
